§2. Definitions
1. Customer: a natural person, legal person or organisational unit that uses the Shop or places an order.
2. Consumer: a natural person who concludes a contract with the Seller that is not directly related to their business or professional activity.
3. Entrepreneur with consumer rights (przedsiębiorca na prawach konsumenta): a natural person who concludes a contract directly related to their business activity, where the content of the contract shows that it is not of a professional nature for that person. The provisions of the Terms and Conditions concerning the Consumer with regard to withdrawal from the contract and complaints also apply to an Entrepreneur with consumer rights.
4. Goods: a movable item presented in the Shop.
5. Contract: a contract for the sale of Goods concluded at a distance between the Customer and the Seller.
§3. General rules
1. The Shop sells collectible vehicle models. Most Goods are used items available as a single piece. The photos in a listing show the specific piece being sold, and its condition is described in the listing. New and factory-packed Goods are marked as such.
2. To use the Shop, you need a device with internet access, an up-to-date web browser with cookies and JavaScript enabled, and an active email address.
3. The Customer may not provide unlawful content or use the Shop in a way that disrupts its operation.
4. Information about Goods in the Shop constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code (Kodeks cywilny).
§4. Electronic services
1. The Seller provides the following electronic services free of charge: browsing the Shop, the cart, the order form, the Customer account, the contact form, the form for submitting a collection for buy-back, and the newsletter.
2. The contract for maintaining an account and the newsletter contract are concluded for an indefinite period. The Customer may cancel them at any time without giving a reason, by sending a message to sklep@resoraki.com or by clicking the unsubscribe link in a newsletter message.
3. Complaints about electronic services can be sent to sklep@resoraki.com. The Seller responds within 14 days.
§5. Orders and conclusion of the Contract
1. Orders can be placed 24 hours a day, with or without a Customer account.
2. To place an order, the Customer adds Goods to the cart, provides the details needed to fulfil the order, chooses the delivery and payment method, and then confirms the order using a button indicating an obligation to pay. Before confirming, the Customer sees the total price including delivery costs.
3. The Contract is concluded when the Customer receives an email confirming acceptance of the order. This message constitutes confirmation of the conclusion of the Contract on a durable medium.
4. The Goods are offered simultaneously in other sales channels. If an order cannot be fulfilled because the piece has already been sold, the Seller will inform the Customer without delay, no later than within 3 working days, and refund the full amount paid.
§6. Prices and payments
1. Prices in the Shop are gross prices and include VAT. The Shop displays prices in Polish zloty and, for Customers from other countries, also in the currency indicated in the Shop.
2. The price of Goods does not include delivery costs. Delivery costs are shown in the cart and in the order summary before the order is placed.
3. The available payment methods are shown at checkout before the order is placed. Orders are paid in advance.
4. When a price reduction is announced, the Shop shows, next to the reduced price, the lowest price of the Goods in the 30 days before the reduction was introduced.
5. A proof of purchase is issued for each order. The Seller issues a VAT invoice if the Customer provides invoice details, including the EU VAT number, when placing the order.
§7. Delivery
1. The Seller dispatches Goods within 24 hours of the payment being credited, on working days.
2. Delivery methods, costs, times and countries are set out in the Shipping Policy, which forms part of the Terms and Conditions.
3. The risk of accidental loss of or damage to the Goods passes to the Consumer when the Goods are handed over to the Consumer.
§8. Right of withdrawal from the Contract
1. The Consumer may withdraw from the Contract without giving any reason within 14 days of the day on which they came into possession of the Goods.
2. How to withdraw, the rules for sending back the Goods and refunding payments, and the model withdrawal form are set out in the Returns Policy, which forms part of the Terms and Conditions.
§9. Complaints
1. The Seller is liable to the Consumer for the conformity of the Goods with the Contract on the terms set out in the Act of 30 May 2014 on consumer rights (ustawa z dnia 30 maja 2014 r. o prawach konsumenta), for 2 years from delivery of the Goods.
2. A complaint can be submitted by email to sklep@resoraki.com or in writing to the Seller's address. The complaint should preferably include the order number, a description of the non-conformity, ideally with photos, and the request.
3. If the Goods do not conform to the Contract, the Consumer may demand their repair or replacement and, in the cases specified in the Act, submit a declaration of a price reduction or of withdrawal from the Contract. As most Goods exist as a single piece, replacement is usually impossible.
4. The Seller responds to a complaint within 14 days of receiving it. Costs related to a justified complaint, including the cost of sending back the Goods, are borne by the Seller.
§10. Out-of-court dispute resolution
The Consumer may use out-of-court complaint handling and redress procedures, in particular the assistance of a district (powiat) or municipal consumer ombudsman, mediation, or the permanent consumer arbitration court at the provincial inspectorate of the Trade Inspection (Inspekcja Handlowa). Information about these procedures is available at polubowne.uokik.gov.pl. Using them is voluntary and requires the consent of both parties.
§11. Customers who are businesses
1. The provisions of this paragraph apply to Customers who are neither Consumers nor Entrepreneurs with consumer rights.
2. The Seller's liability under the statutory warranty for defects of the Goods (rękojmia) is excluded pursuant to Article 558 § 1 of the Civil Code.
3. The Seller's liability is limited to the amount paid for the order and does not cover lost profits, except for damage caused intentionally.
4. Disputes are resolved by the court having jurisdiction over the Seller's registered office.
§12. Reviews of Goods
1. Reviews of Goods come exclusively from people who bought the Goods in the Shop. The Seller sends the invitation to leave a review by email after the order has been fulfilled, via the edrone platform; reviews from purchases are marked as “Verified purchase”.
2. On the home page, the Shop shows selected reviews from the Google Business Profile of the Seller's bricks-and-mortar shop in Kraków, quoted unchanged, together with the overall rating from all Google reviews and a link to the full list. Google does not verify whether the author of a review made a purchase.
3. The Seller does not buy reviews, does not commission them and does not change their content; it publishes both positive and negative reviews. The Seller does not transfer reviews from Allegro or eBay to the Shop.
§13. Personal data
The controller of Customers' personal data is the Seller. The rules for processing data are described in the Privacy Policy.
§14. Final provisions
1. Contracts are governed by Polish law. The choice of Polish law does not deprive a Consumer whose habitual residence is in another country of the protection afforded to them by the mandatory provisions of that country's law.
2. Contracts with Customers whose habitual residence or registered office is in Poland are concluded in Polish, and contracts with Customers from other European Union countries are concluded in English. The Terms and Conditions are available in Polish, English and the other languages of the Shop. In the event of discrepancies between language versions, the version more favourable to the Consumer applies.
3. The Seller may amend the Terms and Conditions for important reasons: changes in the law, changes in payment or delivery methods, or changes in the scope of services provided. Orders placed before the change are governed by the Terms and Conditions in force at the time the order was placed. Customers with an account are informed of the change by email at least 14 days before it takes effect and may close their account during that time.
4. No provision of the Terms and Conditions excludes or limits the Consumer's rights under mandatory provisions of law.
